Farmers Win Court Battle

A Whitchurch dairy farmer has won a six figure damages in a courageous court battle against the manufacturers and suppliers of defective farm equipment.

The farmers found themselves with a classic problem for small businesses; the expensive equipment they had bought did not work properly and damaged their profits but they were concerned about the possible cost of losing a long and expensive court battle to prove their case. The case against the manufacturers and installers concerned a poorly installed and defectively designed milking parlour which caused injury and infection to the cows and failed to cope with a planned increase in the herd.

They were comforted about the risk they faced when they secured help from LawAssist, a special insurance scheme that provided finance for the case and protection from the cost of losing the equivalent of Legal Aid for businesses. When the suppliers made a low offer of settlement to try and buy them off, the farmer's costs were insured if they held out for a full settlement.
